1. Overview

This website is operated by AJC Corporation Pty Ltd ABN 54 785 967 794, trading as BB4D.

Throughout these Terms of Service, the terms “BB4D”, “we”, “us” and “our” refer to AJC Corporation Pty Ltd trading as BB4D.

BB4D operates the website www.bb4d.com.au and provides access to its information, products, shopping features and associated services.

By visiting our website, creating an account or placing an order, you agree to these Terms of Service and any policies referenced in them, including our:

• Return and Refund Policy;
• Shipping and Delivery Policy; and
• Privacy Policy.

Please read these Terms carefully before using our website.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot legally be excluded.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to sell products to you.

2. About BB4D products

BB4D—Best Before, Better Deals—is an online grocery store offering discounted food, beverages, pantry products and other goods.

Products available through BB4D may include:

• products approaching their best-before date;
• products that have passed their best-before date;
• excess or surplus stock;
• discontinued products;
• short-dated stock;
• products in superseded or changed packaging; and
• products with minor cosmetic packaging imperfections.

Relevant date information and product conditions will be disclosed on the product page where applicable.

A disclosed best-before date, packaging change or minor cosmetic packaging imperfection is not, by itself, evidence that a product is defective or misdescribed.

Products with a best-before date may legally be sold after that date when they remain fit for human consumption. However, some quality characteristics—such as flavour, colour, aroma, texture or crispness—may gradually change.

BB4D does not sell food after its use-by date.

3. Acceptance of these Terms

By accessing the website or placing an order, you confirm that:

• you have read and understood these Terms;
• the information you provide is accurate and current;
• you have the legal capacity to enter into a purchase agreement; and
• you agree to comply with all applicable laws.

If you are under 18, you may only use this website with the permission and supervision of a parent or legal guardian.

• manufacturers may update packaging, ingredients or product information;
• colours may appear differently depending on your screen;
• packaging-change products may arrive in an older or newer design;
• minor cosmetic imperfections may be present where disclosed; and
• best-before dates may differ between batches or product variants.

If the delivered product is materially different from its description, please contact BB4D. Your rights under the Australian Consumer Law may apply.

6. Ingredients, allergens and dietary information

Product ingredients, allergen statements, nutritional information and dietary claims are generally supplied by manufacturers or distributors.

Manufacturers may change recipes, ingredients, production processes or packaging without notice. For this reason, you should always check the physical product label before consuming a product.

If you have a food allergy, intolerance or specific dietary requirement, do not rely solely on website photographs or summary descriptions.

Please contact us before ordering if you require additional information. Do not consume a product if its label does not provide the information you need or if you are uncertain whether it is suitable for you.

BB4D does not provide medical or dietary advice.

Nothing in this section limits our responsibility where a product is incorrectly described or fails to comply with a consumer guarantee.

7. Storage and product handling

Customers are responsible for following the manufacturer’s storage, preparation and usage instructions after delivery.

Products should be stored in appropriate conditions and should not be consumed if they show signs of spoilage, contamination or serious packaging failure.

Do not consume a product if it has:

• a broken or compromised seal;
• swelling or bulging;
• leakage;
• mould;
• an unusual odour;
• evidence of contamination; or
• any other indication that it may be unsafe.

Contact BB4D promptly if a product arrives damaged or appears unsafe.

8. Product availability

BB4D specialises in surplus, rescued, discontinued and limited-quantity products. Availability can change quickly, and products may sell out without notice.

Adding a product to your shopping cart does not reserve it. A purchase agreement is not final until we accept your order.

We may apply reasonable purchase limits to ensure fair access to limited stock or to prevent unauthorised resale.

If a product becomes unavailable after you place an order, we will contact you and provide an appropriate refund, replacement or alternative option. We will not substitute a product without your agreement.

9. Prices and payments

Unless stated otherwise, prices displayed on www.bb4d.com.au are in Australian dollars and include GST where applicable.

Prices may change at any time before an order is placed. A price change will not affect an order we have already accepted unless there has been an obvious pricing or technical error.

You agree to provide accurate and complete billing and payment information.

Payment may be processed through Shopify Payments or another approved payment provider. Your use of a third-party payment provider may also be subject to that provider’s terms.

BB4D does not receive or store your complete payment-card details where payments are processed by an external payment provider.

10. Orders and order acceptance

Submitting an order is an offer to purchase products from BB4D.

After you place an order, you may receive an automated order confirmation. This confirms that we have received the order but does not necessarily mean that we have accepted it.

We may reasonably decline, limit or cancel an order where:

• a product is unavailable;
• incorrect pricing or product information was displayed;
• payment cannot be authorised;
• fraud or unauthorised activity is suspected;
• delivery cannot be completed to the supplied address;
• quantity limits have been exceeded;
• the order appears to be intended for unauthorised resale; or
• fulfilling the order would breach a law or regulatory requirement.

If we cancel an order after payment has been received, we will refund the affected amount to the original payment method.

11. Pricing and website errors

Occasionally, the website may contain an incorrect price, description, promotion, delivery charge, date or availability statement.

Where we discover an error before accepting an order, we may correct the information and ask whether you would like to proceed.

If an order has been affected by an obvious and genuine error, we may contact you to offer the correct product or price or cancel and refund the affected part of the order, subject to applicable law.

Nothing in this section permits BB4D to engage in misleading or deceptive conduct or avoid an obligation under the Australian Consumer Law.

12. Order cancellations and amendments

If you need to cancel or change an order, contact BB4D as soon as possible.

We cannot guarantee that an order can be changed or cancelled after it has entered processing, packing or dispatch.

If we approve a cancellation before dispatch, the refund will be issued to the original payment method.

If an order has already been dispatched, our Return and Refund Policy will apply. Food and grocery products are not generally returnable because of a change of mind.

13. Delivery

Delivery times displayed on the website are estimates unless expressly stated otherwise.

Delays may occur because of carrier disruptions, weather, peak trading periods, natural disasters, incorrect address details or other circumstances outside our reasonable control.

You are responsible for:

• providing a complete and accurate delivery address;
• checking delivery details before submitting your order;
• ensuring someone can receive the delivery where required; and
• collecting parcels from a carrier or collection point within the specified period.

Nothing in this section limits any rights you may have where BB4D fails to supply products within a reasonable time or otherwise breaches a consumer guarantee.

14. Returns, refunds and consumer guarantees

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

You may be entitled to a remedy when a product is:

• unsafe or unfit for consumption;
• faulty or damaged;
• materially different from its description;
• different from the product ordered;
• missing from your delivery; or
• otherwise unable to meet an applicable consumer guarantee.

The remedy available will depend on the nature and seriousness of the problem and may include a replacement, refund or another remedy required by law.

BB4D does not generally provide returns or refunds when you simply change your mind about a food or grocery product.

A clearly disclosed approaching or past best-before date does not, by itself, entitle a customer to a refund. However, this does not affect your rights if the product has another problem that was not disclosed or does not meet a consumer guarantee.

15. Promotions and discount codes

Promotional offers, discount codes and special prices may be subject to additional conditions.

Unless otherwise stated:

• only one discount code may be used per order;
• discount codes cannot be exchanged for cash;
• expired discounts will not be accepted;
• discounts cannot be applied retrospectively;
• promotions are subject to stock availability; and
• discounts may exclude certain products, delivery charges or gift cards.

We may withdraw or correct a promotion where it contains an obvious error, is affected by fraud or misuse, or cannot lawfully be honoured.

16. Gift cards and store credit

Gift cards and store credits are subject to the conditions displayed when they are issued.

They may not be exchanged for cash except where required by law.

Customers are responsible for protecting gift-card details from unauthorised use. Contact BB4D promptly if you believe a gift card has been lost, stolen or used without authorisation.

17. Accounts and customer information

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

You must provide accurate, current and complete information when creating an account or placing an order.

Please notify BB4D promptly if you suspect unauthorised access to your account.

We may suspend an account where we reasonably suspect fraud, misuse or a breach of these Terms.

BB4D handles personal information in accordance with its Privacy Policy and applicable privacy laws.

By using the website, you acknowledge that certain information may be provided to service providers that help us process payments, fulfil orders, deliver parcels, operate the website or communicate with customers.

If you submit a review, photograph, comment, suggestion or other content to BB4D, you confirm that:

• it does not infringe another person’s rights;
• it is not defamatory, unlawful, threatening or abusive; and
• it does not contain malicious code or unsolicited advertising.

You grant BB4D a non-exclusive, royalty-free licence to display, reproduce and use submitted content in connection with BB4D’s website, products and marketing.

You retain ownership of your original content.

We may moderate or remove content where we reasonably believe it breaches these Terms or applicable law.

Unless otherwise stated, the website and its content—including the BB4D name, logos, graphics, photographs, text, design and layout—are owned by or licensed to BB4D.

Third-party product names and trademarks remain the property of their respective owners.

Customers remain responsible for losses caused by their unlawful use of the website, misuse of products or failure to follow clearly provided storage, preparation or safety instructions.

24. Product recalls and safety notices

If BB4D becomes aware of a product recall or material safety issue affecting a product we have sold, we may contact affected customers using the contact details supplied with their orders.

Customers should follow all recall, disposal, return and safety instructions provided by BB4D, the manufacturer or an appropriate government authority.

25. Suspension and termination

You may stop using the website at any time.

They replace any previous version of the website terms but do not exclude representations or rights that cannot legally be excluded.

29. Governing law

These Terms are governed by the laws of Victoria, Australia.

You and BB4D submit to the courts and tribunals that have jurisdiction under applicable Australian law.

Nothing in this section limits any right you may have to bring a claim in another jurisdiction where applicable consumer law permits it.

30. Changes to these Terms

We may update these Terms to reflect changes to our products, website, business practices or legal obligations.

The latest version will be published on this page with an updated effective date.

Changes will apply from the published effective date and will not retrospectively remove rights relating to an order already accepted.
